User agreement - Trusty Trades Limited

Welcome to Trusty Trades Limited (“Trusty Trades”, “we”, “us”, or “our”). By accessing www.trustytrades.ie (the "Site") and using our services, you agree to be bound by the terms and conditions set out in this User Agreement (“Agreement”). These terms apply to both Service Providers and Service Buyers (collectively, "Users").
Trusty Trades Limited is registered in Ireland under company number [Insert CRO Number], with its registered office at [Insert Address], Ireland. This Agreement is governed by the laws of Ireland.
1. Definitions
- “Service Provider”: An individual or entity offering services via the Site, including subcontractors, agents, or employees.
- “Service Buyer”: Any user seeking services via the Site.
- “User”: Any visitor to or registrant of the Site, including both Service Buyers and Service Providers.
- “Site”: www.trustytrades.ie and all related subdomains.
2. Acceptance of Terms
By using the Site, you agree to comply with this Agreement, our Privacy Policy, and all applicable laws, including but not limited to the Sale of Goods and Supply of Services Act 1980, the Consumer Protection Act 2007, the Data Protection Act 2018, and the Electronic Commerce Act 2000.
If you do not agree to be bound by this Agreement, do not access or use our services.
3. Changes to Terms
We may amend this Agreement at any time by posting the updated terms on the Site. Such changes shall comply with relevant provisions of Irish contract and consumer protection law. All amendments will take effect 30 days after being posted. Continued use of the Site after this period constitutes full acceptance of the revised terms.
4. How it Works
Trusty Trades provides a secure, compliant platform where Service Buyers can post detailed job descriptions via a streamlined online form. Once submitted, Trusty Trades uses location-based matching to notify vetted, registered Service Providers in the relevant trade and geographical area. Interested Providers can then contact the Buyer directly to offer quotations. A maximum of four Providers may be permitted to respond per listing, ensuring competition while maintaining quality and fairness. All interactions are governed by Irish consumer protection, e-commerce, and contract legislation.
Buyers can post jobs for free or opt for enhanced visibility for a fee. Providers must pay a registration fee and job completion fees. We do not guarantee responses or job outcomes.
5. Using the Site
You must be 18 years of age or older to use the Site and legally capable of entering into binding contracts in accordance with the provisions of the Electronic Commerce Act 2000 and Irish contract law. You may not use the Site if:
- You are under 18.
- You have been suspended or removed.
- You violate any laws, infringe on intellectual property rights, or provide false or misleading content.
Businesses registering must have authority to bind the entity.
6. Account Restrictions
We reserve the right to take any action necessary to protect the integrity and lawful operation of the Site, including suspending or permanently terminating accounts, where Users, in our sole discretion, act in a manner inconsistent with this Agreement or in violation of applicable Irish law, including but not limited to:
- Harass our staff or other users.
- Submit unverifiable information.
- Generate excessive negative feedback.
We may also close unconfirmed or inactive accounts.
7. Service Buyer Terms
- Buyers may post jobs for free.
- Paid services do not guarantee Provider responses or suitability.
- Duplicate job postings within 6 months are prohibited.
- Feedback is expected upon job completion.
- Buyers posting excessive jobs without hiring may be restricted.
8. Service Provider Terms
- Providers pay a registration fee and a job completion fee.
- Fees are outlined in our Fees Policy and are subject to change.
- Providers must not spam or misuse the communication tools on the Site.
9. Communications and Spam
Spam is not tolerated. Users must not:
- Send unsolicited communications.
- Add users to mailing lists without consent.
We reserve the right to monitor and act against misuse.
10. Content License
By submitting content to the Site, you grant Trusty Trades a non-exclusive, worldwide, royalty-free, irrevocable license to use, reproduce, display, distribute, and adapt the content for operational, promotional, and legal compliance purposes, in accordance with applicable Irish intellectual property law, including the Copyright and Related Rights Act 2000. You warrant that you have the right to grant this license and that the content does not infringe any third-party rights.
11. Liability and Warranties
We do not guarantee:
- Completion, timeliness, or quality of services rendered by Service Providers, which remain the responsibility of the respective parties in accordance with the Sale of Goods and Supply of Services Act 1980.
- The accuracy, authenticity, or legal validity of the qualifications, solvency, insurance, or accreditation claimed by Providers, which must be independently verified by Buyers.
- Payment performance by Service Buyers, which is not under our control and must be contractually arranged between the involved parties.
Trusty Trades does not review communication or transactions between Users. All interactions, agreements, and exchanges are the sole responsibility of the Users involved and should be conducted in accordance with Irish law. Trusty Trades accepts no liability for disputes or issues arising from such interactions. Use of the Site is at your sole risk.
Our liability is limited to €120 in aggregate, except in cases of fraud or personal injury due to our negligence.
12. Service Provider Qualifications
- Providers must submit 5 references, which we may verify.
- Mobile numbers of Providers and referees are validated using industry-standard verification tools to ensure accuracy and reduce the risk of fraudulent activity, in accordance with Irish data protection and consumer law requirements.
- We do not guarantee the validity, authenticity, or current status of a Service Provider’s insurance or accreditation. Buyers are solely responsible for requesting and reviewing relevant documentation before any work commences, and are advised to consult appropriate professional or regulatory bodies where applicable, in line with Irish industry standards and public safety obligations.
- Buyers must independently verify a Service Provider’s insurance policies, trade qualifications, and applicable professional accreditations before engaging in any contractual agreement. This includes requesting original or certified documentation and consulting relevant Irish regulatory or certification bodies where appropriate.
13. Release and Disputes
You release Trusty Trades from any and all claims, demands, or damages (actual or consequential) arising out of or in any way connected with disputes between Users, to the fullest extent permitted by Irish law. In accordance with the Mediation Act 2017, Users are encouraged to first attempt resolution through direct communication and, where appropriate, through independent mediation prior to seeking formal legal remedies.
14. Privacy
We only share data with registered Service Providers who have explicitly expressed interest in a particular job, and only to the extent necessary for legitimate service fulfilment. All personal data is collected, processed, and stored in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR), the Data Protection Act 2018, and the ePrivacy Regulations (S.I. No. 336/2011). We take appropriate technical and organisational measures to safeguard your information. Please refer to our Privacy Policy for a detailed explanation of your rights and how we process your data.
15. Indemnity
Users agree to fully indemnify and hold harmless Trusty Trades, its officers, directors, employees, agents, and affiliates from and against any and all claims, losses, liabilities, expenses, damages, and costs (including reasonable legal fees) arising directly or indirectly from their breach of this Agreement, violation of any applicable Irish law or regulation, or misuse of the Site. This indemnity obligation shall survive termination of this Agreement.
16. Severability
If any clause is held invalid, the remainder of the Agreement shall remain in full effect.
